1. Definitions

In these terms: "Seller" or "we" means AB Sawmill; "Buyer" or "you" means the person or business buying goods or services from us; "Goods" means the timber products and related items you agree to buy; "Price" means the price agreed or quoted for the Goods and any delivery charges.

2. Acceptance of Terms

By accessing our website or placing an order, you accept and agree to be bound by these Terms and Conditions. These terms apply to all contracts for the sale of Goods by us and prevail over any conflicting terms in your own documentation unless we agree otherwise in writing.

3. Products and Services

AB Sawmill supplies timber products and related services, including but not limited to:

  • Timber and lumber in various grades and dimensions
  • Custom cutting and processing
  • Wholesale and retail supply
  • Consultation and quotation services
  • Delivery and logistics arrangements

4. Quotations and Orders

Quotations are valid for the period stated (or a reasonable time if not stated) and are subject to acceptance. All orders are offers to purchase subject to our acceptance. We may refuse any order. You must ensure that measurements and specifications you provide for custom or made-to-order items are correct; we are not responsible for errors in dimensions or specifications supplied by you.

5. Price and Payment

Prices are as quoted or as on our current price list at the time of order, and may be subject to change due to material or cost variations. Payment terms will be specified at order confirmation. Unless otherwise agreed, payment of the total price (including any applicable taxes and delivery charges) is required as per the agreed terms-often in full before dispatch. We are not obliged to fulfill orders where a pricing error has occurred; we will correct errors as soon as possible and inform you. Title to the Goods remains with us until full payment is received.

6. Quality and Timber Specifications

Timber is a natural product. It may exhibit natural variation including knots, grain, colour, slight shrinkage or expansion, and minor surface characteristics. Such variation does not necessarily indicate a defect. We strive to supply goods that match agreed specifications; custom orders will be processed according to the specifications agreed with you. Sizes and dimensions are approximate where industry tolerances apply. Images on our website are for illustration; actual products may vary in shade or appearance.

7. Delivery and Risk

Delivery times are estimates only and are not guaranteed. We will use reasonable efforts to meet stated delivery dates but are not liable for delay. Risk of loss and title to the Goods pass to you upon delivery to the carrier or upon collection from our premises. You are responsible for providing adequate facilities and labour for unloading where required. We are not liable for delays or failures caused by circumstances beyond our reasonable control (e.g. acts of God, strikes, shortage of materials, transport delays).

8. Inspection and Claims

You must inspect the Goods on delivery. Any claim for short delivery, visible damage, or non-conformity must be notified to us within a reasonable time (e.g. 48 hours for obvious damage). Signing for delivery without notation may be treated as acceptance of the Goods in good condition. For defective or faulty Goods, we will at our option replace the Goods or refund the price in accordance with applicable law.

9. Returns and Cancellation

Custom, made-to-order, or cut-to-size timber is generally non-returnable unless faulty. For other Goods, returns may be accepted at our discretion and may be subject to a restocking or handling charge. You must contact us before returning any Goods. Refunds will be processed in accordance with our returns policy and applicable law. Cancellation of orders may be possible before dispatch; once Goods are in production or dispatched, cancellation may not be accepted or may incur charges.

10. Limitation of Liability

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, business, or data). Our total liability for any claim arising from or in connection with these terms or the supply of Goods shall not exceed the price paid for the relevant Goods. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Force Majeure

Neither party shall be liable for delay or failure to perform if the delay or failure results from events or circumstances outside its reasonable control (e.g. natural disasters, war, strikes, pandemics, failure of suppliers or transport). The affected party shall be entitled to a reasonable extension of time to perform.

12. Intellectual Property

The content, design, logos, and materials on this website are protected by copyright and other intellectual property rights. You may not copy, reproduce, or use them without our prior written consent except for personal, non-commercial use.

13. Modifications

We reserve the right to modify these terms at any time. Changes will be effective upon posting on this page with an updated "Last updated" date. Your continued use of our website or services after changes constitutes acceptance of the modified terms.

14. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
